论渔业法第四十六条情节严重认定标准研究

摘　　要：进入二十一世纪以来,伴随着全球化趋势的进一步增强,以及“一带一路”倡议的进一步推进,陆域资源已经远远不能满足现今人类社会发展的需求,海洋的重要作用正在日益显现。而渔业作为海洋资源开发与利用中的基础性产业,其地位不容小觑。中国作为海陆兼备的区域性濒海大国,在渔业发展以及渔业管理上一直采取积极的态度,尤其是在立法层面,《中华人民共和国渔业法》(以下简称《渔业法》)第四十六条明确对涉外渔业生产、涉外渔业资源调查等行为予以规制。但是该法条对“情节严重”的表述仍然不明确,为海上执法带来了极大不便。因此,本文在阐述“情节严重”认定标准的基础上,从海上行政管辖权范围、行政执法刑事司法界限、执法力度三个角度分析当前涉外非法渔业生产等行为在行政处罚中的问题成因,并提出相应对策建议。Since the beginning of the 21st century, with the further strengthening of the trend of globalization and the further advancement of the Belt and Road Initiative, land resources have been far from meeting the needs of the development of human society, and the important role of the ocean is becoming increasingly apparent. As a basic industry in the development and utilization of Marine resources, the position of fishery cannot be underestimated. As a regional coastal power with both land and sea, China has always adopted a positive attitude in fishery development and fishery management, especially at the legislative level. Article 46 of the Fisheries Law of the People’s Republic of China (hereinafter referred to as the Fisheries Law) clearly regulates foreign-related fish-ery production and foreign-related fishery resource investigation. However, the expression of “serious circumstances” in this law is still unclear, which brings great inconvenience to maritime law enforcement. Therefore, on the basis of elaborating the criteria for the identification of “serious circumstances”, this paper analyzes the causes of the current problems in the administrative punishment of foreign-related illegal fishery production from three perspectives: the scope of maritime administrative jurisdiction, the criminal judicial limits of administrative law enforcement and the intensity of law enforcement, and puts forward corresponding countermeasures and suggestions.
