信息化时代公民网络隐私权的法理学分析——以“扫码点餐”为例

摘　　要：随着互联网技术的不断革新,人们工作和生活方式变化的速度也在不断加速。由此,人类在享受现代科学技术带来巨大便利的同时也在面临前所未有的巨大挑战。正如,与人们生活、工作紧密相关的信息网络技术,就潜藏着随时会泄露公民个人隐私,在网络平台被搜索甚至被快速传播的各种风险,进而造成无法挽回的局面。由此,对于如何加强公民在信息化时代下的隐私权保护就成为了亟须解决的现实问题。本文将围绕热点话题——“扫码点餐”为切入点,详细阐述信息化时代公民网络隐私权及其保护的法理学问题。首先,对传统隐私权的定义进行界定,分析公民网络隐私权的概念及其新特点,继而从法理学基础中的秩序、自由、正义价值角度进一步论述网络隐私权存在的必要性,其次,对信息化时代公民网络隐私权在其发展中面临的问题进行分析。最后,针对存在的现实问题提出了相应的解决建议。With the continuous innovation of Internet technology, the speed of change in people’s work and lifestyle is also accelerating. As a result, human beings are enjoying the great convenience brought about by modern science and technology while also facing unprecedented and enormous challenges. For example, information network technology, which is closely related to people’s life and work, lurks with various risks of leaking citizens’ personal privacy at any time, being searched on online platforms and even being rapidly disseminated, which may result in an irreversible situation. As a result, how to strengthen the protection of citizens’ privacy in the era of information technology has become a real problem that needs to be solved. This paper will focus on the hot topic—“code ordering” as an entry point, and elaborate on the jurisprudence of citizens’ online privacy and its protection in the era of information technology. Firstly, it defines the definition of traditional privacy, analyses the concept of citizens’ online privacy and its new features, then further discusses the necessity of online privacy from the perspective of the values of order, freedom and justice in the foundation of jurisprudence, and then analyses the problems faced by the citizens’ online privacy in the development of the information age. Finally, it puts forward relevant suggestions for solving the existing practical problems.
