摘　　要：作为中华民族的母亲河,黄河孕育了华夏文明,见证了中华民族的复兴,在我国的经济社会发展和生态安全方面扮演着至关重要的角色。然而,随着黄河流域的发展,流域内的经济和生态矛盾逐渐凸显,对区域和国家的平稳发展产生了严重的负面影响,因此,黄河治理保护已成为国家高度关注的重点,而实现黄河流域的高质量发展则是当务之急。在此背景下,本文首先论述黄河流域发展以及保护状况,并黄河流域进行生态保护的重要性。其次,继续论述了当前黄河流域生态保护法治化中的不足,包括法律规范不完备;法律实施过程中不完善;法治保障中法治人才能力不足、公民法治意识较淡薄等问题。接下来,积极汲取国内外流域法治中治理相关经验,对黄河流域从系统治理角度推进生态保护法治化提出了构想。As the Mother River of the Chinese nation, the Yellow River gave birth to the Chinese civilization, witnessed the revival of the Chinese nation, and played a vital role in the economic and social development and ecological security of our country. However, with the development of the Yellow River basin, the economic and ecological conflicts in the basin have become increasingly prominent, which has had a serious negative impact on the steady development of the region and the country, the protection of the Yellow River has become the focus of national attention, and the realization of high-quality development of the Yellow River basin is an urgent matter. In this context, this paper first discusses the development and protection of the Yellow River basin, and the importance of ecological protection of the Yellow River basin. Secondly, it continues to discuss the shortcomings of the current Yellow River basin ecological protection in the rule of law, including incomplete legal norms;In the guarantee of the rule of law, there are some problems, such as the lack of legal talents and the weak awareness of the rule of law. Then, based on the domestic and foreign experiences, the author puts forward the idea of promoting ecological protection legalization from the perspective of systematic governance.
