档案安全领域行刑衔接制度的构建与完善

摘　　要：档案方面违法犯罪的规制主要体现在行政罚和刑事罚两个层面。当前我国档案违法呈现出高发性、刑事处罚不畅的特点,反映出档案行政执法与刑事司法的衔接困境,限制了我国档案安全工作的顺利进行。《档案法》是《刑法》的前置法,《刑法》是《档案法》的有力保障,《档案法》与《刑法》的相关条款,为档案行政执法和刑事司法的衔接提供了法律依据,奠定了法律基础。但《档案法》与现行《刑法》存在法律体系衔接不足、不同部门之间缺乏协同性、案件移送不畅、证据转换存在障碍以及检察监督乏力等突出问题。为使档案安全领域行刑衔接机制高效运行,有力地打击档案违法犯罪行为,应进一步调适行刑衔接的立法制度、健全案件移送机制、建立证据转换机制、完善检察监督制度,以期保障档案安全,促进档案事业进一步发展。The regulation of illegal crimes in archives is mainly embodied in two levels: administrative punishment and criminal punishment. At present, the law enforcement in our country presents the characteristics of high incidence and poor criminal punishment, which reflects the difficulty of the convergence between the law enforcement administration and the criminal justice, which limits the smooth development of our archives security work. The Archives Law is the pre-law of the Criminal Law, and the Criminal Law is a strong guarantee of the Archives Law. The relevant provisions of the Archives Law and the Criminal Law provide a legal basis and lay a legal foundation for the connection between the administrative enforcement of archives and criminal justice. However, there are some outstanding problems between the Archives Law and the existing Criminal Law, such as lack of connection between the legal system, lack of coordination between different departments, poor transfer of cases, obstacles in evidence conversion and weak procuratorial supervision. In order to make the execution linkage mechanism in the field of file security operate efficiently and effectively crack down on the illegal and criminal acts of files, we should further adjust the legislative system of execution linkage, improve the case transfer mechanism, establish the evidence transfer mechanism, and perfect the procuratorial supervision system, so as to ensure the file security and promote the further development of archives.
