知识数据库平台的反垄断思考——针对知网涉嫌垄断案分析

摘　　要：知识产权的反垄断任务迫在眉睫。针对知网涉嫌垄断一案梳理其前因后果,从相关市场界定、市场支配地位认定、“滥用”的界定三个方面分析其是否构成滥用市场支配地位的垄断行为,从而分析反垄断法在知识产权保护领域的法律逻辑。通过引入法经济学理论,剖析“知网模式”的两层法律关系,分别得出反垄断法对知识产权的保护途径:1) 要求具有市场支配地位的知识资源数据库平台将许可使用合同提交市场监督局备案,防止强势一方设置不公平条款限制、排除弱势一方与第三方合作;2) 要求具有市场支配地位的知识资源数据库平台定期将定价标准、价格变动条件、价格浮动范围等依据提交市场监督局审核,如发现其对知识产权有垄断嫌疑应当及时开展调查。The anti-monopoly task of intellectual property is imminent. In view the suspected monopoly case of CNKI, this paper tried to sort out the causes and consequences, and whether it constitutes a monopolistic behavior that abuses market dominance is analyzed from three aspects: the definition of relevant market, the determination of market dominance and the definition of “abuse”, so as to analyze the legal logic of the Anti-Monopoly Law in the field of intellectual property protection. By introducing legal and economic theories, the two layers of legal relationships of the “CNKI model” are analyzed, and the ways of protecting intellectual property rights under the Anti-Monopoly Law are obtained: 1) the knowledge resource database platform with a dominant market position is required to submit the license contract to the Market Supervision Bureau for the record, so as to prevent the strong party from setting unfair terms and restrictions, and excluding the weak party from cooperating with a third party;2) Require knowledge resource database platforms with a dominant market position to regularly submit pricing standards, price change conditions, price fluctuation ranges, and other bases to the Market Supervision Bureau for review, and if it is found that it is suspected of monopolizing intellectual property rights, the Market Supervision Bureau shall promptly carry out investigations.
