摘　　要：随着科技的发展,我们已经从“互联网经济时代”进入“互联网平台经济时代”,阿里巴巴、京东、美团等电商平台如雨后春笋般涌现。互联网平台企业依靠其先发优势,逐步发展成为具有市场优势地位的超级网络平台。在市场竞争日益加剧的背景下,互联网平台企业为了获得更大的市场份额,不断出现新型的垄断行为,这些行为不仅破坏了市场的竞争秩序,还损害了消费者的权益,并妨碍了技术创新的进程。因此,如何在新型市场环境下规范市场竞争、预防互联网平台企业实施限制竞争行为已经成为我国《反垄断法》亟待解决的新问题。基于这一研究思路,此文首先对互联网平台新型垄断行为的表现进行论述,通过一系列滥用市场支配地位的行为揭示互联网平台滥用市场支配地位扰乱竞争秩序的严重危害。其次,分析互联网平台垄断法律规制的立法现状以及互联网平台垄断法律规制的必要性。最后,从改进互联网相关市场的界定办法,完善互联网平台支配地位的认定以及全面提升反垄断执法水平几个方面对互联网平台企业新型垄断行为的规制方面提出相关建议。With the development of science and technology, we have changed from “Internet economy era” to “Internet platform economy era”, internet platforms like Alibaba, JD.com and Meituan are springing up. Internet platform enterprises rely on its first-mover advantage, and gradually develop into a market-dominant position of the Super Network platform. Under the background of increasing market competition, in order to gain more market share, new monopolistic behaviors emerge constantly, which not only destroy the competitive order of the market, it also undermines the rights of consumers and impedes the process of technological innovation. Therefore, how to regulate market competition and prevent internet platform enterprises from restricting competition has become a new problem to be solved in our anti-monopoly law. Based on this research thinking, this article first discusses the performance of the new monopoly behavior of Internet platform, through a series of abuse of market dominance behavior reveals the internet platform abuse of market dominance to disrupt the competitive order of serious harm. Secondly, it analyzes the status quo of the legislation and the necessity of the legal regulation of the Internet platform monopoly. Finally, this paper puts forward some suggestions on how to improve the legal regulation of new monopolistic behaviors of Internet platform enterprises from the aspects of improving the definition of Internet-related market, improving the identification of the dominant position of Internet platforms and comprehensively enhancing the level of anti-monopoly law enforcement.
