摘 要:长期以来,我国的行政诉讼采用的管辖制度都是根据行政区划进行管辖的划分,但是这种制度导致了严重的地方保护现象。为解决这种情况,各地区都进行了跨区域管辖制度的试点,可大致分为交叉类管辖和集中类管辖两类。但是,当前的试点还存在着标准不统一、原告参加诉讼的成本高、法院的审判力量不足的问题,并且有可能导致新的地方干预的出现。对于这些问题,需要从制度、标准、技术等多个角度入手解决。对管辖法院和适用案件的选择应制定明确的标准,并允许原告自由选择。加强法院审判队伍的建设,合理分配司法资源,完善配套的执行措施,合理使用互联网技术提高审理效率。For a long time, the jurisdiction system adopted in China’s administrative litigation is divided according to the administrative division, but this system leads to serious local protection phenomenon. In order to solve this situation, various regions have carried out the pilot system of transregional jurisdiction, which can be roughly divided into two categories: cross-type jurisdiction and centralized jurisdiction. However, the current pilot still has some problems, such as inconsistent standards, high cost for plaintiffs to participate in litigation, insufficient trial power of the court, and may lead to the emergence of new local intervention. For these problems, it is necessary to solve them from many angles such as system, standard and technology. Clear criteria should be established for the choice of competent courts and applicable cases, and plaintiffs should be allowed to choose freely. Strengthen the construction of court trial teams, rationally allocate judicial resources, improve supporting enforcement measures, and rationally use Internet technology to improve trial efficiency.
