摘　　要：商业贿赂已成为当今破坏市场经济秩序,破坏社会风气的顽疾,并且作为一种"潜规则",长期不能被执法部门予以约束而大行其道。它严重危害国家的政治和经济的健康发展,如何有效治理商业贿赂受到社会各方广泛关注。本文通过分析商业贿赂的概念成因及其社会危害,并提出治理商业贿赂法律问题方面的建议,为我国治理商业贿赂提供有益的思考。Commercial bribery has become a serious disease that destroys the order of the market economy and destroys the social atmosphere, and as a kind of 'hidden rules', it can not be restricted by the law enforcement department for a long time. It is a serious threat to the country's political and economic development, how to effectively govern commercial bribery is the important topic. This paper analyzes the concept of commercial bribery and its social harm, and puts forward some suggestions on how to deal with the legal issues of commercial bribery.
