我国法律职业伦理建构的德性要义

摘　　要：强化法律职业伦理规范建设对于提升法律职业道德有着非常重要的作用。自近代以来法律由以德性和人格为中心转向以原则和规范为中心。我们对法律职业伦理的关注不只是规范,同时更是规范的理由。法律职业经过“公正”这一终极价值的范导,选择了一致同意的道德契约,由此构建了人类社会的司法制度。公正之运用,既可生存于司法亦可毁灭于司法。法律职业的道德目的是衡量一切行为的道德善恶或道德价值的标准。只有当拥有创造性特征的道德实践行为引起实践变化或对实践做出贡献时,才能被视为道德批判的对象和目标。我们绝不能低估我国法律职业道德建设过程中的中国特色和中国元素的重要性。中国法律职业伦理建设的当务之急,以及未来中国社会法律职业伦理信念及其表达,需要同时做出两方面的努力:既要指向法律职业伦理制度的规范化、合法化、合理化以及正当性本身,又要构建作为法律职业德性素养培育载体的法律职业伦理新框架。Strengthening the development of norms on legal ethics plays a very important role in enhancing professional ethics in law.Since recent times,law has shifted from being centered on virtue and personality to being centered on principles and norms.The attention paid to legal ethics is not limited to the norms,but including the reasons for the norms.The legal profession,guided by the ultimate value of"justice",has chosen a consensual moral contract,thus establishing the judicial system of human society.The application of justice can either survive or perish in the administration of justice.The moral purpose of the legal profession is the standard by which the moral goodness or moral value of all actions is measured.Only when the morality-related practical behavior with creative characteristic causes changes to the world practice or contributes to it,such behavior can be regarded as the object and target of moral criticism.The importance of Chinese characteristics and Chinese elements in the process of constructing the legal ethics in China shall not be underestimated.The present construction of legal ethics in China,as well as the beliefs of legal ethics and their expression in Chinese society in the future,requires two aspects of efforts:namely,the standardization,legitimization,rationalization,and justification of the system of legal ethics itself,and,more importantly,the construction of a new framework of legal ethics as a vehicle for the cultivation of virtue-facet quality of legal profession.
