摘  要:中国高等学校的自主办学与西方大学自治存在类型差异。以建国之前主要参照西方大学自治、建国之后曲折探索集中管理制度为基础,改革开放以来通过自主创新而逐渐建构起来的高等学校自主办学制度,适应了中国高等教育系统的行政松绑期待、效率至上旨趣以及支撑大国复兴心态。它以1979年高等学校主动争权为历史起点,在逻辑上历经政治确权、行政授权并最终得到法治赋权。由此而获得的办学自主权属于国家本位的权力范式,具有程序控权的权力性质,形成了行政推进、政校协同的权力运行机制,具备多维复合的权力特征,因此极具中国特色。As far as the universities and colleges governance is concerned,there is a type difference between China’s selfgovernance and the western autonomy.Based on the reference from Western university autonomy before 1949 and the tortuously exploration of the centralized management system after 1949,the self-governance system of Chinese higher education institutions,which has been gradually constructed through independent innovation since the implementation of the reform and opening policy,has adapted to the administrative deregulation expectations,efficiency-oriented interest and country rejuvenation supporting mentality of Chinese higher education system.It took the initiative to compete for power in 1979 as a historical starting point,and logically underwent political confirmation and administrative authorization,and finally authorized by the rule of law;the power of institutions’self-governance thus obtained belongs to the state-based power paradigm and has the essence of procedural control,possesses power operation mechanisms of administrative impetus and coordination between government and institutions,and has multi-dimensional and composite power features.Therefore,it can be said that it has Chinese characteristics.
