摘 要:跃出程序法和证据法的学科范围,以刑事诉讼总体性视域审视,产生刑讯逼供的原因在于“由供到证”的侦查方式。在部分案件中,之所以侦查机关将口供作为证据之源,对口供形成单一需求,是因为被害人受到侵害后在当时的侦查体制下基本不报案。1996年公安部推广福建省漳州市的“110经验”,降低了被害人的报案成本,催化了被害人的报案意愿。110指挥中心逐渐释放效用,将犯罪信息供给从犯罪嫌疑人端转移到被害人端,形成了口供的替代供给机制。针对口供替代供给机制生成的历史回顾,提示这一机制对于职务犯罪案件调查的参考,以及在以证据、程序为中心的传统研究方法之外,建立刑事诉讼总体性视域的方法论意义。From the perspective of the whole criminal litigation system rather than procedural law or evidence law,the reason for extorting confessions by torture lies in the investigative method of obtaining evidence from confessions.In some criminal cases,the reason why the investigative organizations took confessions as the source of evidence and formed a single demand for confessions is that the victims did not report the cases under the investigation system at that time.In 1996,the Ministry of Public Security promoted the“110 Experience”in Zhangzhou City,Fujian Province,which reduced the reporting costs for victims,and increased their willingness to report to the police.The effectiveness of the establishment of the police command center as an organizational structure has been released gradually,shifting the main source of criminal information from the suspects to the victims,and forming an alternative mechanism for confession.The historical review of the generation of the alternative supply mechanism suggests the reference value of this mechanism to the investigation of duty crimes,as well as the methodological significance of establishing a overall horizon on criminal litigation in addition to the traditional research methods focusing on evidence and procedure.
