摘　　要：认罪认罚从宽制度改革已经进入全面改革阶段,但对于"认罚"的基本内涵、核心要义等基础理论问题,仍存在较大争议,"认罚"的法理还有待凝练。应当区别"认罚"作为一个词语所可能表达的含义与"认罚"作为一个法律概念所具有的含义。作为一个法律概念,认罚是指犯罪嫌疑人、被告人认可检察机关提出的处罚方案。侦查机关不能独立开展认罚活动,尽管认罚包括对定罪建议的认可,但与真诚悔罪没有必然联系,"认罪认罚可以从宽"应当被解释为"如果不能从宽,就不适用认罪认罚从宽制度"。认罚改革促成了两种模式的量刑建议制度,即职权模式与协商模式。认罚的核心要义是协商式的量刑建议,而构建科学的量刑协商机制的基础在于以程序思维构建程序规则,关键在于确保控辩平衡。The reform of the system of pleading guilty and accepting punishment with leniency(PGAPL) has entered the stage of comprehensive reform, but there is still great controversy on the basic theoretical issues such as the basic connotation and core meaning of "accepting punishment", and the "Fali" of "accepting punishment" has yet to be condensed. The meaning of "accepting punishment" as a phrase should be distinguished from the meaning of "accepting punishment" as a legal concept. As a legal concept, "accepting punishment" refers to the recognition of the punishment scheme proposed by the procuratorate. The investigation organ cannot independently carry out the activities of "accepting punishment". There is no inevitable link between the acceptance of punishment and sincere repentance. If the accused cannot be given a light punishment, then the system of PGAPL cannot be applied. The legislation in China has taken a very cautious attitude towards criminal negotiation, but the reform of the system of PGAPL has indeed promoted the formation of two models of sentencing proposal system, namely, the power mode and the negotiation mode. The core meaning of "accepting punishment" is sentencing proposal negotiation. To construct a scientific sentencing proposal mechanism, we should establish the procedural rules based on the procedural thinking and ensure the balance of prosecution and defense.
