专家辅助人参与环境民事诉讼的现状检视与制度重构

摘　　要：当前,专家辅助人在参与环境民事司法实践中,存有专家辅助人参与诉讼方式单一、身份地位不明、意见采信率低等诸多方面的问题。从目前这一制度设计初衷来看,专家辅助人参与环境民事诉讼在意见客观性、意见效力、证据采信规则适用等方面存在难以调和的矛盾。因此,借鉴域外国家对专家辅助人参与环境民事诉讼的相关规定,将专家辅助人参与民事诉讼的身份界定为证人能有效解决目前我国该制度所面临的难题。与此同时,从环境民事司法的独特性出发,在现有法律框架下将专家陪审员制度立法化是重构专家辅助人参与环境民事司法制度的有益延伸。In the current practice of expert assistants participating in environmental civil justice,such problems arose as the single method of expert assistants participating in litigation,unidentified status and low acceptance rate of opinions.Judging from the original intention of the current system design,the participation of expert assistants in civil litigation has contradictions difficult to reconcile in terms of objectivity of opinions,validity of opinions,and application of evidence acceptance rules.Therefore,the difficulties faced with the current system in China can be solved effectively by learning from the relevant regulations of foreign countries on the participation of expert assistants in environmental civil litigation,and defining the status of expert assistants and civil litigation as witnesses.Starting from the uniqueness of environmental civil justice,the legislation of the expert juror system under the existing legal framework is a beneficial extension of the system reconstruction of expert assistants to participate in the environmental civil justice system.
