摘 要:基于Deakin etc.(2007)的度量办法并对之加以改进,本文首次在省际层面对中国劳动保护强度进行了度量,获得了劳动合同标准化、工作时间与休假制度、劳动合同执行与解除、集体议价制度、劳动争议处置等5个维度的劳动保护强度指数。度量结果显示,1994-2016年间,中国劳动保护强度总体上有较大幅度的提高,但不同地区之间在劳动保护强度上存在差异。2008年新《劳动合同法》实施前后相比较,劳动合同的执行和工作时间与休假制度指数的趋同性和稳定性最好,而劳动合同标准化、集体议价制度、劳动争议处置这三方面的差异是导致地区间劳动保护强度差异的主要来源。The implementation of labor protection policies is one of the key means for the government to manage the changes in the labor market.For the first time,this paper classifies and assigns the labor protection policies and regulations of China’s provinces,and obtains the labor protection intensity indexes of the five dimensions of labor contract standardization,working hours and leave system,labor contract execution and termination,collective bargaining system,and labor dispute settlement at the provincial level from 1994 to 2016.According to the measured results,we found that the labor protection intensity in China improved greatly during the inspection period,while there were differences in labor protection intensity between different regions.After the implementation of the new labor contract law,the convergence and stability of labor contract execution,working hours and vacation system indexes are the best,and the differences in labor contract standardization,collective bargaining system and labor dispute settlement are the main sources of labor protection intensity differences among regions.
