民法典视野下的船舶买卖不破租赁问题研究

摘　　要：我国《民法典》不是简单地对现有民事法律的汇编,而是增加了较多修改和创新规则。《民法典》的出台,正值《海商法》修订期间,有必要结合《民法典》的规定进一步做好《海商法》的修订工作。分析《民法典》可能对船舶物权相关的买卖不破租赁原则带来的影响,并提出相关的解决思路和建议。The Civil Code of the PRC is not simply a compilation of existing civil laws but adds a lot of modifications and innovative new rules.The introduction of the Civil Code coincides with the revision of the Maritime Law of the PRC,and it is necessary to further improve the revision of the Maritime Law in conjunction with the provisions of the Civil Code.This article analyzes the possible impact of the Civil Code on the principle of Sales Cannot Devastate Lease①related to the property rights of ships and puts forward relevant solutions and suggestions.
