摘  要:劳动法司法实践中出现枉顾劳动法强制性规范、套用民法中的强制性规定、不识别或不当识别劳动法强制性规范等做法,而理论上对劳动法强制性规范缺乏准确界定、识别标准和方法尚付阙如等导致司法判决不能充分说理,遂致裁判标准不一、同案不同判之后果。劳动法上的确存在劳动法自身之强制性规范。因此对其加以界定与识别确有必要,确定判定标准与识别方法乃是当务之急。最低标准的劳动条件、不可任意变更适用之劳动法实体或程序规定以及公共政策可作为其判定标准,然后结合文义解释和目的解释两种方法加以具体识别。In the judicial practice of labor law,there are some practices,such as neglecting the mandatory rules of labor law,applying the mandatory provisions of civil law,not identifying,or improperly identifying the mandatory rules of labor law.In theory,the lack of accurate definition of the mandatory rules of labor law and the lack of identification standards and methods lead to insufficient reasoning in judicial decisions,resulting in different judgment standards and different judgments in the same kind of cases.It is true that there are mandatory rules of labor law itself in labor law.Therefore,it is necessary to define and identify them,and it is urgent to set up the criteria and identification methods.The minimum standard of labor conditions,the applicable substantive or procedural provisions of labor law that cannot be arbitrarily changed,and public policy can be used as the judgment criteria,and then they can be specifically identified by two methods of literal interpretation and purposive interpretation.
