摘 要:“区域能否成为独立发展权主体”是区域经济法体系建构中必须解答的基础性问题,但现有观点缺乏合理性,导致区域发展权主体范畴模糊不清。为修正传统区域发展权主体理论的缺陷,须明确“区域应回归发展权主体范畴”的观点。为此,应依循“权利公共性与共同体共伴生”的逻辑,揭示经济区域包容发展权公共性的特质,剖析三类经济区域通过共同目标、集体认同和归属感成为共同体的能力,梳理区域共同体的利益冲突、修正措施,并以“资源输出地输入地利益补偿的法制建设”为特定场域,具体分析现有资源均质区发展权主体资格未明确的法制缺陷,围绕政策先导、立法项目和立法规划三方面内容开展区域法制建设活动。Whether a region can become an independent development right subject is a basic question that must be answered in the construction of the regional economic law system,but the existing views lack rationality,thus resulting in a blurred scope of regional development rights subjects.To this end,we should follow the logic of“the publicity of rights and the co-existence of the community”,reveal the characteristics of the public nature of the inclusive development right in the economic region,analyze the ability of the three types of economic regions to become a community through common goals,collective identity and sense of belonging,sort out the conflicts of interests and amendment measures of the regional community,and take the“legal system construction of the interest compensation of the input area of the resource export area”as the specific field,specifically analyze the legal defects of the existing resource homogeneous area where development right subject qualifications are not clear,and then based on the three aspects of policy pilot,legislative projects and legislative planning to carry out regional legal system construction activities.
