摘　　要：由掌控着社会科学话语权的两门学科———经济学和法学融合而成的法经济学使我们以一个新的方式体会法律体系,其作为法学方法有其独特的一面,但由其本身特质,也存在着自身的软肋。法经济学以其实证分析的优势见长,考虑我国市场经济体制的现状,在分析某项法律制度时,对自身的情况作充分的调查,再进行富有针对性也更具有指导性的分析,那才是达到了分析研究的目的。Law and Economic theory,combined with the two controlling sciences——Economics and law,supply us a new angle of view to inspect the law system.As the matter of fact,this new method has both the merits and the demerits for its unique characteristics,especially for its positive analyzing.Owing to the situation of our country,Law and Economic theory should be applied respectively after sufficient inquiry.How to use the method in law fields properly and correctly,this paper supply some suggestive notes.
