摘　　要：中国当代法制中,法律传统的本土资源主要以三种形式存在:一是为当代中国法制所传承的传统法律原则和法律精神;二是遗存于当代中国法制中并被赋予新的生命力的传统实体法律制度;三是当代中国法制所保留并改良的传统程序法律制度。这些本土资源构成了中国法制现代化的现实基础,深刻影响着人们的思想行为和法制的发展。In modernized legal constructions of China,there re three forms of the native resources of traditional law mostly.The first is the traditional legal principle and spirit which passed by modern legal system of china;the second is the traditional substantial legal system which existed in modern legal system of china;and the third is the traditional procedural legal system which keep down by modern legal system of china.These native resources constitute real foundation of modernized law of china,which impact p...
