摘　　要：诱惑侦查 ,是犯罪侦查中一种特殊的侦查方式 ,但对其合法性存在争议。本文针对实践中两类诱惑侦查的特征和法律性质 ,从法理角度划清了诱惑侦查的合法与非法的界限 ,着重剖析了“犯意诱发型”诱惑侦查的违法性危害及法律后果。Encouragement, which is a especial investigate measure in criminal procedure.Its validity has been disputed in academic circle.This article tries to discuss the borderline of legitimacy and illegality, by analyzing the characteristic of the two types of encouragement and analyzed the hazard and consequence of the type of induce predisposition in law.
