摘　　要：传统诉讼文化乃是一笔瑕瑜互现的法律遗产,但身处现代西方语境中,我们经常有意无意地扩大其负面的影响,忽视其合理因素。本文以"诉讼认识论——诉讼观念——诉讼模式"为视角,全面审视传统诉讼文化在诉讼制度现代化的进程中存留和发展的可能性。The traditional procedural culture is a law heritage,which has defects as well as merits.However,in the atmosphere of western ideology,we usually magnify its negative influence whereas ignore its positive factors.The article surveys comprehensively the possibility of which the traditional procedural culture exists and develops in modern times by the view of procedural epistemology,procedural notion and procedural mode.
