摘 要:随着事业单位改革的不断深化,人事争议也逐年攀升。目前人事争议的处理途径十分有限,主要表现为人事争议仲裁制度。在近年来的实践中,该制度操作层面的问题不断暴露。为充分发挥人事争议仲裁制度的功能,必须分析隐藏在现实背后的理论问题,立足于事业单位的改革方向和人事聘用合同的法律属性,完善人事争议仲裁体制。With the intensification of the government-sponsored institutions reform, personnel disputes come to increase constantly. Present handling ways of the disputes are rather limited, with arbitration being the primary means. As many operational problems continue to appear in recent years, we must explore the theoretic problems behind the realty and improve the system based on the reforming direction of the government-sponsored institutions and the attributes of personnel employment contract for the purpose of its better functioning.
