摘　　要：在我国假冒盗版侵权犯罪活动日益猖獗、市场经济秩序被严重扰乱、对外贸易受阻的严峻形势下,作为重要的刑事执法部门,公安机关依照法律、法规担负着知识产权刑事保护之责。但因知识产权刑事立法以及公安自身条件等主客观因素的影响,我国知识产权刑事保护难获实效。公安机关必须积极研究破解之策。In China,criminal activities of counterfeit,infringement and piracy are rampant day by day,thus severely disturb market order and obstacle foreign trade.Public security organs,as an important department of pen- alty law enforcement,are in charge of protecting intellectual property according to laws and regulations.But for subjective and objective factors such as lack of related criminal laws about intellectual property and restriction of the organs themselves,the legal protection of intellectual property in China can hardly be practically effective.There- fore,the countermeasures need to be explored.
