两大法系证明标准之比较

摘　　要：通过两大法系诉讼证明标准的比较,可以得出如下结论:大陆法系在刑事、民事诉讼中适用的是同一种证明标准,大陆法系的民事证明标准明显高于英美法系.After comparing the standards of proof of two legal families,the author draws a conclusion that in the civil law system the same standard of proof is used in both criminal and civil procedures,and the civil proof standard of the civil law system is obviously higher than that of the common law system.
