摘 要:共有人优先购买权和承租人优先购买权是我国两种重要的优先购买权。当前对两优先购买权是否会发生竞合以及发生竞合时应当如何选择,理论界与实务界还有很大争议。通过对共有份额与共有物的区别与联系,以及当共有人同意出卖共有物时他们是否享有优先购买权的分析,认为两优先购买权很有可能会发生竞合。当两优先购买权发生竞合时,基于立法目的及其他方面的考虑,应该选择共有人优先购买权优先于承租人优先购买权。the preemption right of the part owner and the leaseholder are two important preemption rights in China.There are still great disputations in theoretical and practical field,mainly on whether preemption right will be concurrent and how to choose when the concurrence took place.Through the distinguishing and integrating joint owned share and commonable matters,and the analysis on whether one should enjoy the preemption right in case of his willing of selling commonable matters,this paper considers that these two preemption rights will probably be concurrent.When these two preemption rights get concurrent,taking legislation aim and other aspects into account,we should choose the preemption right of the part owner instead of that of the leaseholder.
