摘　　要：死刑核准权是国家审判权的集中体现,是死刑复核程序的中心问题。我国现行立法和司法实践中对于死刑核准权的规定和适用存在着某些不妥之处,这直接影响了我国死刑政策的实现,妨碍了刑事法人权保障功能的达成。本文在死刑核准权从“下放”到“回归”的历史变迁中,深刻检讨死刑核准权“下放”之弊端,并在此基础上分析了死刑核准权回归的法律价值。The approval authority of death penalty is the central problem of checking death penalty as well as the central embodiment of the State's judicial authority.
