摘　　要：基金实际设立并不是启动确权诉讼的先决条件,按照现行法律的规定,即使基金尚未设立,债权登记和确权诉讼也必须进行。那么基金最终并未审理,已进入审理程序的确权诉讼该如何处理呢?法律对此并未作具体规定。通过对这起特殊确权诉讼案件的分析,详尽论述了这一问题的处理方式,指出了立法上的缺陷并对如何完善立法提出了见解。Constitution of limitation fund for maritime claims is not the precondition of bringing an action to have a claim confirmed. How to deal with the action in respect of confirming a claim having entered into hearing procedure if limitation fund for maritime claims didn't constitute ultimately? No existing law can resolve this problem. The author pointed out flaws in legislation and put forward advice of legislation after analyzing this special action confirming a claim.
