摘　　要：理论界对单位犯罪主观罪过方面存在肯定及否定之说,并各有其学及根据,本文通过对其主观罪过的法理及实证分析,使肯定论得到支持。The academic circles has the affirmative theory and the negative theory to subjective aspect of the unit crime, and both these theories respectively have them to study the principle basis. This article maintains the affirmative conclusion through jurisprudence and positive analysis of the two theories?subjective offence.
