摘　　要：前店后床的事实,用现有法律概念难于定性是住所还是经营场所。法官用营业时间来界定事实性质,存在用不确定概念解释不确定概念的逻辑理性欠缺,但不能掩饰其对社会纠纷解决的实际作用。在各种社会矛盾冲突频发的背景下,逻辑理性向纠纷解决妥协了,司法裁判呈现出一种调解式判决的样态。The current legal concepts are difficult to determine whether the fact that bed after the store is residence or place of business.Judge defining the nature of facts with business hours is using indefinite concepts interprets indefinite concepts,but it s useful in settling social disputes.Under the background of frequent emergence of various social conflicts,logic rationality compromises to settlement of disputes,and mediation is more employed in judicial judgment.
