摘 要:房屋租赁权是一种债权的物权化还是一种债权或者物权,历来争论很大,通过正反论证、类比论证、利益衡量的方法,对将房屋租赁权定位为债权的物权化这一学说进行质疑,可以认为房屋租赁权是用益物权。It has been argued for a long time that the Leasehold of House is Creditor s Right,Real Right or Creditor s Right with the character of Real Right.In this paper,the author will,by way of arguing pro and con,analogous argumentation and benefit balance,put forward that Leasehold of House is a Usufructuary Right on the basis of criticizing the theory that Leasehold of House is Creditor s Right with the character of Real Right.
