摘　　要：刑事人身检查是一种重要的侦查取证手段,在实践中容易侵犯被检查人的身体权、隐私权等基本权利。刑事人身检查的法律属性应为强制措施。完善我国刑事人身检查制度应规定人身检查的原则、身体检查的种类和适用条件、赋予被检查人员应有的诉讼权利、建立对违法进行身体检查所取得证据的排除规则以及样本销毁制度。The criminal personal examination is an important way to obtain evidence.However,it may violate the right of physical health,the right of privacy and so on in practice.The legal attribute of criminal personal examination belongs to compulsive measure.We should perfect our country system of criminal personal examination through establishing human body check principles,constituting the category of physical examination with additional terms,providing the appeal rights and excluding evidence illegally obtained ...
