摘　　要：论文从制度变迁史的角度,梳理了自中华人民共和国成立至今食品安全标准法律制度的历史演进,指出2009年颁布的《中华人民共和国食品安全法》是对我国食品安全标准法律制度的根本性重塑。论文剖析了中国食品安全标准的强制性,并指出应以食品安全国家标准为核心建构中国食品安全标准体系,应注重发挥食品安全企业标准的作用。应从人员遴选、规范利益冲突和健全专业分委员会制度三方面规范食品安全标准制定中的专家咨询制度。应以风险分析为基础,以国际标准和国际食品安全风险评估结果为参照,推进中国食品安全标准法律制度的改革。From the viewpoint of institutional reform,it gives an outline of the historical evolution of food safety system in China.Food Safety Law of PRC issued in 2009 is fundamental reform of our food safety standard law.Food safety standard is compulsory standard;it should give more attention to national food safety standard,it should exert the function of enterprise standard.As to national food standard review committee,the constitution should be fairly balanced,the conflict of interests should be controlled,and it should strengthen the function of specific subcommittees.Food standard should be based on the result of risk analysis;it also should refer to international standards and international risk assessment results.
