摘  要:资金的缺乏是影响农村经济发展的关键性问题之一,多年来农村以外的资金来源多为国家支农资金,而商业性融资尤其是负债融资数量很少,原因是农民缺乏用于借款担保的财产。为了解决这一问题,有些地区开始进行土地承包经营权抵押融资试点。但是,由于我国现行法律制度和政策环境的局限,用土地承包经营权直接抵押融资时,债权人实现其抵押权存在着相当大的困难,担保效果很难显现。因此,新的抵押方式的创设成为从试点到推广的需要。Lack of funding is one of the key issues that impact the rural economic development.Over the years,most of the funds in rural areas were from the national funds for supporting agriculture,and commercial financing,especially debt financing accounted for only a small proportion,the reason is farmers lacking of the property for the loan guarantee.To solve this problem,some areas started to pilot land contractual management mortgage finance.However,due to the limitations of China's current legal system and the policy environment,it is difficult for secured creditors to achieve their mortgage under the situation of directly using of the land contract management rights for mortgage financing.Therefore,a new way of mortgage is needed.
