摘　　要：反担保制度是指第三人为债务人向债权人提供担保时 ,由债务人向第三人提供的确保第三人追偿权实现的担保制度。本文评述了国内外反担保制度的立法情况 ,论述了反担保的基本特征、种类、成立要件与效力范围 。Counterguarantee is a kind of guarantee systems that a third party can fulfill his right of recourse on the debtor for warranty when the third party furnishes the security for the debtor. This article comments on the institution of counterguarantee system abroad, the primary characters, typies, conditions of establishment, scope of validity of counterguarantee and probes into some difficult problems about counterguarantee.
