摘　　要：对我国高等院校在校生的年龄段及民事行为能力、权利能力进行了划分和分析，论述了高校与学生之间的法律关系，提出了将年满１６ 岁不满１８ 岁的大学生确定为完全行为能力人的立法建议；This paper makes a partition and analysis on the age segment,civil conduct capacity and right capacity of students in higher institutions in China.Itelaborates the relationship between higher institutions and students,and puts forward a legislation suggestion that is to regard the students aged from 16 to 18 in college as men of full conduct capacity.It also demonstrates the species of personal injury accidents in college and the rules of responsibility bearing.
