摘　　要：面对当代中国法习相悖的现实,一方面我国民族千百年来崇尚人伦、权力和礼仪,另一方面现代社会要求通过法律来建构新的社会秩序,作者认为我们有责任和义务从本国、本民族的实际情况出发,追求二者之间的“和谐一致”.Legal construction can sometimes bring itself in sharp contrast with conventions.For thousands of years, China has been deeply immersed in the snare of human relations, power and numerous rituals, Now, as China proceeds with reform and modernization programm, the rule of law should be in place. This essay discusses the possibiliry of 'a harmonious unity' of modern laws and traditional conventions.
