摘　　要：从新闻自由和新闻工作的具体实践而言,记者拒证权有其建构的合理性。而从司法的角度来看,记者拒证权保障了新闻自由,却妨碍了司法公正。记者拒证权的悖论的实质是新闻自由与司法公正之间的一种博弈,是法律对两种价值的平衡与取舍。According to freedom and practice of the press,there is a legal construction for the reporter's privilege.However,from the judiciary perspective,the reporter's privilege restrains the public from knowing the truth,and thus sabotages judicial justice.The controversy over the paradox of the reporter's privilege is a game between the free press and the judicial justice,which is also the balance and decision-making of the law over two values.
