摘 要:原告与收案人民法院之间关于行政案件管辖权限的争议缺乏一个公正解决的机制,严重损害了司法的公信力。应当从尊重原告的选择权出发,按照两审终审制和保障人民法院独立审判的要求,建立公正的行政案件"管辖"权限争议解决机制。全国人大常委会或者最高人民法院应设立专门机构处理行政案件是否由人民法院主管的争议、人民法院与人民法院之间的管辖权限争议以及原告与收案人民法院之间的管辖权限争议。收案人民法院的上一级人民法院在作出指定管辖等裁定之前,应征求原告意见。原告对这类裁定不服,应有权上诉。The absence of a fair jurisdictional disputes settlement mechanism on administrative cases between the plaintiff and the court which receives the complaint has seriously damaged the credibility of the judiciary.We should establish an impartial mechanism to resolve jurisdiction disputes on administrative cases according to the two-tier trial system and the requirement to ensure people's court's independence in exercising judicial authority.The NPC Standing Committee or the Supreme People's Court should establish a special agency to deal with the disputes on whether a lawsuit is within the scope of administrative actions,jurisdictional disputes between the two courts,and jurisdictional disputes between the plaintiff and the court which receives the complaint.Before making a ruling such as jurisdiction designation,the people's court at the next higher level rather than the court which receives the complaint shall solicit the opinions of the plaintiff.The plaintiff who refuses to accept the ruling shall have the right to appeal.
