摘　　要：从"国家-法庭(法官)-社会"三元冲突关系的视角出发,法庭和法官在一定的制度条件下,并不必然完全代表国家立场或者社会利益司法,其行动和策略本身包含着功利化的契机。我国乡村司法的治理化定位以及由此而来的纯行政化绩效、考评机制在法官与案件处理之间形成一种制度化的利益纽带,法官出于自我保护与自利的目的最终造成乡村司法的策略化。其基本表现是审判的调解化与调解的准审判化,并通过控制情景建构的边界、软硬兼施等一系列具体策略实现调解的既定目的。Based on the tri-conflict perspective of country -judge people's tribunal-society , the peo-ple's tribunal and its judges do not necessarily judge as a interest representative of country or society , but in-clude utilitarian opportunity inn some condition .The governance location and the administrative tendency in administrative and assessing mechanism of our rural judicial have made a institutional interest link between judge and the case , which leads to a kind of tactful judicial for the purpose of self -interest and self -protec-tion .It mainly manifests as on the mediation tendency in trial and trial tendency in mediation and fulfilling the set mediation through a series of strategies like boundary control of the situation and so on .
