公益伦理:一种必要而不必然的社会正义

摘　　要：公益伦理是追求社会正义的一种道德诉求,对弱势群体的关怀体现了公益伦理的价值理念和正义精神。由于现实中制度不可避免地存在某种缺陷性,导致弱势群体处于不正义境域。因此,一种以弱势群体为本的公益伦理是必要的;另一方面,根据制度设计的应然逻辑,在一个正义的、完满的、良序的社会中,公益伦理又是不必然的。作为对社会正义的一种矫正与修补,当前中国公益伦理所要实现的是一种基于弱势群体同意原则的分配正义。Public welfare ethics is considered an appeal for social justice. Its care about the vulnerable groups reflects itsvalues and spirit of justice. It is necessary to orient public welfare ethics toward the vulnerable groups in that their difficulty results from defects of social institutions. On the other hand,however,public welfare ethics is not essential ina society of justice and order. As a supplement to social justice,the public welfare ethics aims for the justice of distribution in favor of the vulnerable groups.
