摘 要:在传统的政治法律体系下 ,政府与公立高校之间是一种内部行政性的委托代理关系 ,在这种关系中 ,政府全面掌握着国家教育权 ,也承担着全部的责任 ,而公立高校则只是政府的附属机构 ,只能服从政府的安排和指令 ,少有自主权。这种关系容易导致教育腐败和学术腐败等问题。公立高校成为独立法人之后 ,政府与高校之间可能建构一种外部行政委托代理关系 ;根据市场精神及新公共管理理念 ,重新配置国家教育权与社会教育权 ,并在高校主办者之间、高校之间、办学者之间形成竞争性的关系 ,这种新型法律关系 ,能约束政府、高校以及办学者 。The traditional relationship between the Government and public universities, under the corresponding political and legal systems, is that of an internal administrative trust, in which the Government has an absolute control of the education power of the whole nation, but at the same time shoulders the due responsibilities, while public universities, as mere affiliated institutions and hence having little autonomy, could only submit to the plans and instructions from the Government. Such a relation tends to give rise to educational and academic corruptions. Yet after public universities become independent juristic person, that relation might be replaced by an external administrative trust. Then the market and the new public administration principles require that the national and social education power should be re-configured, and that there should engender a competitive relation among all parties concerned. Such a new legal relation could therefore lay a restriction upon both the Government and the universities to guarantee the latter’s independent, autonomous legal status.
