摘　　要：我国《国家赔偿法》和《行政诉讼法》都明确规定 ,行政相对人单独提出行政赔偿请求 ,必须经过行政赔偿先行程序。在行政赔偿先行程序中 ,行政先行赔偿的处理方式、处理程序、行政先行赔偿和赔偿诉讼的有关法律规定的协调是行政赔偿先行程序的重要内容 ,我国立法应当完善这些方面的内容 ,使行政先行赔偿更具有可操作性和实效性。According to 'National Compensation Law' and 'Administrative Procedure Law' of our country, individual demands on compensation should undergo the administrative compensation priority procedure. The stipulations on the mode, procedure and the compensation lawsuit are the important contents in the administrative compensation priority procedure. The legislation of our country should try to improve these contents and ensure the maneuverability and actual effect of the administrative compensation priority procedure.
