摘　　要：在共犯理论中,教唆犯是引起学界争议最大的一种犯罪人类型。应在刑法典中设立教唆罪以解决被教唆人没有犯被教唆之罪的情况,同时,引入想象竞合犯的理论以解决被教唆人实施了被教唆之罪的情况。In the theory of joint offender, the criminal of solicitation is a type of perpetrator that brings large discussion. In this article, the author approves to add the crime of solicitation in the criminal code. Therefore, we can solve not only the phenomenon that the solicited dont commit crime, but also the phenomenon committed by using the theory of imaginative concurrent crime.
