摘　　要：立功是我国刑法中特有的一项从宽处理的制度,贯穿于犯罪分子到案后至服刑期满的整个期间。立功能否成立,应依据主体、主观方面、客观表现、法律效果等来认定。Winning merit, the lenient policy, is the peculiar component of the criminal law. It runs through the whole course from the time when the offender is arrested to the expiration of the term sentence. The adjudgement whether an offender can be given lenient treatment should be made from the corpus, the subjective and objective aspects, the legal effect and so on.
