摘　　要：本文在界定证明责任概念的基础上,通过对行政诉讼和民事诉讼差异的分析,认为应当以修正规范说来确定行政诉讼证明责任的分配,并进而得出应当以范围责任规则作为行政诉讼证明责任分配依据的结论。Having defined the notion of 'burden of proof',this article analyzes the differentiations between administrative litigation and civil citigation,and arguesthat distribution of 'burden of proof'in administrative litigation should be determined by theory of revised norm,then reaches a conclusion that rule of scope burden should be the basis of distribution of 'burden of proof' in administrative litigation.
