摘　　要：本文在揭示简易、小额诉讼程序法理基础后 ,对一些国家和地区的有关立法例进行了比较 ,检讨了我国简易、小额诉讼程序和替代性程序的立法与实践 ,并对完善我国简易、小额诉讼程序与替代性程序的途径进行了探讨。This paper,after revealing the theoretical foundation of the summary,small claim and alternative proceedings,made some comparisons about the legislation of some countries and regions,and by examining the legislation and practice of the summary,small claim and alternative proceedings in China,explored the ways and means for perfecting the Chinese system of summary,small claim and alternative proceedings.
