“红帽子”企业产权现象的理论命题

摘　　要：本文认为,“红帽子”企业的产权现象说明企业产权制度的法律形式与其经济内容有可能不一致,当二者不一致时,决定该企业产权制度实质的是其经济内容,而不是其法律形式;产权的法律形式有其经济价值,这可以用确立它的成本和收益来度量。文章指出,体制环境的变化和企业的成长状态决定着产权制度的成本和收益的变化;某种特定产权制度的效率是相对的,各种不同形式产权制度的相对效率取决于它们各自与体制环境的适应性程度。The author thinks that the property right of enterprises with“Red Cap”illustrates that the legal form of the property system may different from its economic content,and in this situation,it is the economic content rather than the le-gal form that determines the substance of the property system.Then the author points out that the change of the environment of institutions and the situation of a enterprise ,s growth determine the change of costs and earnings of property system.
