摘　　要：本文根据中国近年经济增长和制度变迁的经验。集中研究城市化过程中的农地转让权，重点是相对于使用权，重新界定农地转让权所面临的限制条件和选择。本文探讨了在现存土地转让权的法律安排下人们的实际行为以及这些行为的经济含义，并讨论了将要修订的《宪法》和《土地法》面临的主要选择。Based on the experience of China’s recent economic growth and institutionalchanges, this paper studies the conversion and transfer of agricultural land in China'surbanizationprocess. The central issue is the constraints and alternatives facing the redefinition of the transferrights of agricultural land. We discuss agents'behavior and its economic implications under thecurrent legal arrangements for land transfer rights, and point out the main alternatives for the a-mendment of theConstitutionand the revision of theLand Management Law.
