摘　　要：本文通过对我国法例的分析 ,有关理论的探讨 ,以及外国相关实践的比较研究 ,论述了海上保险人行使代位权的名义问题 ,决定了行使权利的范围和有效性。By comparative study of the cases of China's courts, the relevant theories and the foreign related practice, this paper analyses the name for exercising the right of subrogation in marine insurance and suggests the scope and effect of exercising this right.
