摘 要:随着中国加入WTO以及入世承诺义务的履行,现行行政诉讼受案范围制度已经表现出相当程度的不可接受性与滞后性。制度内在的欠缺与WTO的外部压力,是我国行政诉讼受案范围制度变革和完善的契机,应将抽象行政行为、行政终局裁定、政府的行政指导以及政府授权的非政府团体的行为等都纳入行政诉讼的受案范围。China's scope of Administrative Litigation has become rather unacceptable and lagging as her admission into WTO and the consequent performance of the promised responsibilities, so it is indicated that the internal weakness and the external pressure constitute the necessity and opportunity of a renovation and perfection thereof. The author proposes that the scope of Administrative Litigation includes the abstract administration act, administration final arbitrament, administration direction of government, acts of the non-governmental organization authorized by the government, etc.
